Terms of trade
Please take care to provide complete, correct, and serviceable delivery details for goods purchased. If an incorrect delivery address has been provided by the purchaser in error, we accept no responsibility for its delivery or collection beyond the address provided, or to refund the delivery or goods purchased and delivered to that address.
The purchaser must advise us and the carrier within 5 days of delivery, of any shortfalls or damage to goods delivered.
The purchaser must advise us of any invoice price or quantity queries within 10 days of the invoice date.
We will accept goods returned for credit or replacement only with prior agreement and with an assigned Return Authorisation Number (RAN). A credit note may be issued in lieu of a cash refund on returned goods, at the discretion of Karea Group Ltd. Any concerns must be communicated to Karea Group Limited within 5 days of receipt of goods. Any returns must be in original merchandisable quality with original packaging. Karea Group Limited has sole discretion to agree or refuse returns. A restocking fee may be charged on some agreed returns, at the discretion of Karea Group Limited.
Unless otherwise agreed, Karea Group Limited liability for any goods or services supplied is limited to either; replacing, refunding or repairing any goods agreed by Karea Group Ltd to be defective within their warranty period, to the entire exclusion of any other remedy or claim which but for this condition, the customer might have.
Karea Group Limited shall be under no liability to the customer or any other person for any damage, injury, direct or consequential or other loss, or loss of profit or costs arising whilst any goods are replaced, refunded or repaired. Karea Group Ltd has the sole discretion to choose between replacement, refund, or repair.
Force Majuere: Karea Group Limited shall not be under any liability to the customer for any delays in delivery, however that delay was caused, or for any loss or damage to the goods arising during transit, where such delay, failure, loss, or damage is caused by third party performance, mechanical breakdown of any equipment, weather conditions, strikes, lockouts, labour disputes or restraint of labour, act of God, war (declared or not), any act, regulation, or restriction placed by Government, riot or civil commotion, any act or omission of the purchaser, its servants, subcontractors or agents, or any cause beyond the control of the company.
We have the complete discretion to ration or cancel, and refund any purchase in part or full in any instance, including situations where purchase quantities or purchase patterns are unusual, or stock of a particular item or items is limited or sold out, or the address for delivery cannot be verified, or the delivery address provided cannot be serviced by our carrier/s; if we consider that the most appropriate course of action.
Subject to any terms implied by New Zealand law which cannot be excluded, Karea Group Ltd shall not be responsible or liable, in contract, tort (including negligence), equity or otherwise for any direct, indirect, consequential, special, or punitive damage, or for any loss of profit, income or savings, or any costs or expenses incurred or suffered by the customer or any other person, arising out of, or in connection with, or use of goods or services provided by Karea Group Ltd, other than claims arising under the Consumer Guarantees Act 1993, New Zealand, where applicable. The purchaser has the complete obligation to satisfy themselves that the goods or supplied are;
(a) suitable for the purpose for with they intend to use them.
(b) suitable for any recommendation made to any other person or company of any use thereof.
Law & Arbitration. This Agreement shall be governed by and construed in accordance with New Zealand law. Any controversy or claim between the parties arising out of or related to this Agreement, unable to be settled between them, shall be settled by arbitration before a single arbitrator under the then current rules of the AMINZ (Arbitrators & Mediators institute of New Zealand Ltd). The arbitration shall be held in Wellington New Zealand. The decision and award of the arbitrator shall be final and binding.
Severability. If any provision or portion of this Agreement shall be held invalid under any applicable laws, such invalidity shall not affect any other provision of this Agreement that can be given effect without the invalid provision or portion, and, to this end, the provisions or portions hereof are severable.
To enable service delivery by and through this website we need to rely on many 3rd party services, and programs. Whilst we choose them carefully, and regularly check they are working to expectations, we cannot take responsibility for any errors, issues or delays caused by them.
We have endeavored to ensure that the information on this web site is accurate, current and complete.
